Vendor Terms & Conditions

These Vendor Terms & Conditions (“Terms”) apply to all vendors (“Vendor”, “You”, “Your”) participating in JAPAN STREAT PARTY (“Event”), organised by JAPAN STREAT PARTY PTY LTD (“Organiser”, “We”, “Us”, “Our”).
By submitting an application, paying any fees, or participating in the Event, you agree to be bound by these Terms.

- Event Details
• Event Name: JAPAN STREAT PARTY
• Event Type: Outdoor food, beverage & cultural festival
• Location & Dates: As advised by the Organiser (subject to change)
The Organiser reserves the right to amend the Event schedule, location, operating hours, layout, or program where reasonably required.

- Vendor Eligibility & Compliance
Each Vendor is solely responsible for holding and maintaining all required approvals, licences, permits and certifications, including but not limited to:
• Food business licence / permit
• Public Liability Insurance (minimum AUD $20 million)
• RSA certification (where alcohol is sold)
• Compliance with all local council, health, safety, and regulatory requirements
The Organiser does not verify Vendor compliance and accepts no liability for any breach by a Vendor.

- Stall Allocation & Operations
• Stall size and location are allocated at the Organiser’s discretion
• Vendors must operate strictly within their allocated space
• Set-up (bump-in) and pack-down (bump-out) times must be strictly adhered to
• No obstruction of emergency exits, walkways, or fencing is permitted
Failure to comply may result in immediate suspension of trading without refund.

- Products & Menu
• Vendors may only sell items approved in advance by the Organiser
• The Organiser reserves the right to restrict, remove, or limit menu items to avoid duplication, conflict with sponsors, or operational issues
• No unauthorised price changes or additional products may be sold on-site

- Fees & Payment
• All vendor fees must be paid in full by the due date specified by the Organiser
• Fees are non-transferable
• Participation is not confirmed until full payment is received

- Cancellation & No Refund Policy
Vendor Cancellation
• All Vendor fees are non-refundable, regardless of the reason for cancellation by the Vendor
Event Cancellation / Force Majeure
In the event that the Event is cancelled, postponed, shortened, relocated, or interrupted due to circumstances beyond the Organiser’s reasonable control, including but not limited to:
• Natural disasters
• Severe weather conditions
• Fire, flood, storm, or earthquake
• Pandemic or public health orders
• Government or council direction
• Acts of terrorism, civil unrest, or emergency
NO REFUNDS will be issued under any circumstances.
Vendors acknowledge and accept the commercial risk associated with participating in an outdoor public event.

- Insurance, Risk & Indemnity
• Vendors participate entirely at their own risk
• The Organiser is not responsible for loss of income, loss of profit, equipment damage, theft, or personal injury
• Vendors must indemnify and hold harmless the Organiser against all claims, damages, losses, and liabilities arising from the Vendor’s participation

- Alcohol & Responsible Service
• Alcohol sales are strictly limited to approved Vendors
• All alcohol service must comply with applicable liquor licensing laws
• The Organiser reserves the right to suspend alcohol service at any time for safety or compliance reasons without compensation

- Photography, Video & Promotion
The Vendor grants the Organiser an irrevocable, royalty-free right to:
• Photograph and record the Vendor, staff, stall, and products
• Use such content for marketing, promotional, sponsorship, and media purposes in perpetuity

- Organiser’s Rights
The Organiser reserves the right to:
• Modify stall locations and layouts
• Remove or suspend any Vendor for safety, compliance, or operational reasons
• Enforce all operational decisions in the best interest of the Event
Such actions do not give rise to any refund or compensation.

- Governing Law
These Terms are governed by the laws of Australia, and the applicable state or territory in which the Event is held.
The parties submit to the exclusive jurisdiction of the courts of that state or territory.

- Acceptance
By applying for and participating in JAPAN STREAT PARTY, the Vendor confirms that they have read, understood, and agreed to these Terms & Conditions in full.
